PART B — DATA, DOCUMENTS & INFORMATION
7. All personal information, identity documents, photographs, contact details, address proofs and any other data submitted by the applicant — whether during enrollment or at any subsequent stage — shall become part of the Party's official records and may be retained permanently.
8. The data and documents submitted by members may be used by the Party for the following purposes: internal analytics and statistical surveys; demographic and constituency-level research; Party planning and organisational development; sending official communications, notices, circulars and informational material; delivering membership documents including ID cards, approval letters and certificates; and election-related data processing and candidate evaluation.
9. The Party may contact members via mobile number, email address or any other contact detail provided during enrollment to deliver information, updates, notices, campaign materials, event invitations or any official Party communication.
10. Members consent to receiving communications from the Party through SMS, email, WhatsApp or any other electronic means using the contact details submitted by them. Members may request to opt out of promotional communications but cannot opt out of official Party notices and administrative communications.
11. The Party shall not share, sell or commercially transfer any member's personal data to any third party outside the Party structure, except where required by law or by order of a competent authority.
PART C — PRIMARY MEMBERSHIP
12. Upon successful enrollment and approval, the applicant shall be recognised as a Primary Member of Sarvajan Hitay Party. Primary Membership is the foundational tier of membership in the Party.
13. Primary Membership entitles the member to: participate in Party events, meetings and campaigns; receive official Party communications and materials; apply for Active Membership after fulfilling the eligibility criteria; and hold a valid Primary Member ID card issued by the Party.
14. Primary Membership does not automatically entitle the member to contest any election — whether general, state, local body or organisational — unless the member has been elevated to Active Membership and has received specific approval from the authorised Party committee.
15. Primary Membership remains valid indefinitely unless suspended, revoked or surrendered, subject to the member's continued compliance with the Party Constitution and these terms.
PART D — ACTIVE MEMBERSHIP
16. A Primary Member who fulfils the prescribed eligibility criteria may apply for Active Membership of the Party. Active Membership is the higher tier of membership that confers additional rights and responsibilities.
17. Active Membership is valid for a period of 3 (three) years from the date of approval by the authorised Party authority. Upon expiry, the Active Member automatically reverts to the status of Primary Member until the membership is renewed and re-approved.
18. Active Membership may be revoked at any time by the Party authority if the member is found to be in violation of the Party Constitution, these terms and conditions, or any directive issued by the Party leadership. Upon revocation, the member reverts to Primary Member status with immediate effect.
19. Active Membership entitles the member to: all rights available to a Primary Member; apply to contest elections under the Party banner; participate in organisational elections; and represent the Party in an official capacity as authorised.
20. An Active Member whose membership has expired or been revoked may apply for renewal of Active Membership. Renewal shall be subject to review and approval by the authorised Party authority and is not guaranteed as a matter of right.
PART E — ORGANISATIONAL ELECTIONS
21. Only Active Members in good standing are eligible to participate in organisational elections held within the Party for appointment to internal positions, committees and offices.
22. A member applying to contest an organisational election must not have any pending disciplinary action or inquiry against them at the time of application.
23. The member agrees to accept the decision of the organisational election committee as final and binding and shall not challenge the same in any manner contrary to the Party Constitution.
24. Any information or documents submitted as part of an organisational election application shall be used by the Party for evaluation, verification and record-keeping purposes.
PART F — CONTESTING GENERAL / STATE / LOCAL BODY ELECTIONS
25. Only Active Members who have received explicit written approval from the authorised Party committee are eligible to contest general elections, state assembly elections, local body elections or any other public election under the Party's banner or symbol.
26. A member applying to contest an election must submit all required documents, declarations and information truthfully and completely. Any discrepancy or suppression of information may lead to immediate cancellation of the candidature and revocation of membership.
27. The Party's official election symbol shall only be used by candidates who have received formal approval. Unauthorised use of the Party symbol is a serious violation and shall result in immediate termination of membership and may invite legal action.
28. Approval to contest an election under the Party banner is at the sole discretion of the authorised Party leadership and committee. No member has an inherent right to claim candidature as a matter of entitlement.
29. A member contesting an election under the Party banner shall conduct their campaign in a lawful, ethical and dignified manner, upholding the values and ideology of Sarvajan Hitay Party at all times.
PART G — CONDUCT, DISCIPLINE & REMOVAL
30. Every member shall conduct themselves in a manner that upholds the dignity, reputation and ideology of Sarvajan Hitay Party at all times — whether in public, on social media, in official gatherings or in personal dealings in the context of the Party.
31. Membership shall be immediately suspended or revoked if the member is found to have: provided false, misleading or fabricated information or documents; concealed any material fact; acted against the interests or ideology of the Party; joined or supported a rival political party; been convicted of a criminal offence; engaged in conduct unbecoming of a Party member; or violated any provision of the Party Constitution.
32. The member shall be given a reasonable opportunity to present their case before any disciplinary action is taken, except in cases where immediate suspension or revocation is deemed necessary to protect the interests of the Party.
33. The decision of the authorised Party committee in all disciplinary matters shall be final and binding on the member.
PART H — PROHIBITED CONTENT & USER-GENERATED UPLOADS
34. Every member is strictly prohibited from uploading, submitting or sharing any content — including photographs, images, videos, documents or any other material — that is nudist, obscene, pornographic, sexually explicit, indecent, vulgar, defamatory, hateful, fabricated, or in violation of any law of India including the Information Technology Act 2000, the Indian Penal Code, POCSO and the Indecent Representation of Women (Prohibition) Act 1986.
35. The photograph submitted during enrollment must be a recent, clear, front-facing passport-size photograph of the applicant themselves. Submission of any other person's photograph, an obscene image, a cartoon, a digitally manipulated image or any photograph that does not genuinely represent the applicant is strictly prohibited and shall be treated as a deliberate act of fraud.
36. Any document uploaded must be a genuine, unaltered original or certified copy of the stated document. Submission of forged, tampered or fraudulent documents shall result in immediate and permanent cancellation of membership and may be reported to law enforcement authorities.
37. The Party reserves the right to review, reject or permanently remove any content found to be in violation of Points 34, 35 or 36 above, without prior notice to the member.
38. A member found to have uploaded prohibited content shall face immediate and permanent revocation of membership with no right to appeal, reinstatement or renewal. The Party reserves the right to report such violations to appropriate law enforcement authorities.
39. Members acknowledge that the Party does not endorse or verify user-submitted content at the time of submission. However, upon detection of prohibited content, the Party shall act swiftly to remove it and take appropriate disciplinary action.
40. Any member who becomes aware of another member submitting prohibited, obscene or fraudulent content is encouraged to report the same immediately to the Party through official communication channels.
